Final Verdict: Egypt Court Upholds Death Sentence for Rape and Murder of Sudanese Infant Janet in Cairo

The Court of Cassation upheld the death sentence against the defendant in the case involving the rape and murder of a 10-month-old Sudanese infant, Janet Gomaa, in a public park in Nasr City in April 2025. The court found him guilty of kidnapping the child, assaulting her, and intentionally killing her, issuing a final and conclusive ruling in the case.

On 11 May 2026, the Court of Cassation rejected appeal No 12147 of Year 94, filed by Mohamed S (M.S.) against his death sentence in the case of the rape and murder of a Sudanese infant girl. The ruling is now final and cannot be appealed.

The Public Prosecution’s advisory opinion (which is not binding on the court) recommended rejecting the appeal and upholding the death sentence issued by the lower courts, confirming the defendant’s conviction for killing the infant in order to facilitate rape after abducting her from in front of a neighbour’s apartment while she was playing with other children.

The Sixth Criminal Appeal Court in Nasr City (Tagamoa) ruled on 19 April 2025, unanimously to sentence the defendant M.S. to death by hanging for killing the Janet in Nasr City and disposing of her body in a garbage dump near her home after abducting and assaulting her. The court issued its ruling after receiving the opinion of the Grand Mufti of Egypt, as required in death penalty cases.

The court also rejected the defendant’s appeal in form and substance and upheld the first-instance court’s ruling, which had already sentenced him to death.

The Public Prosecution had referred the defendant, in Case No 5901 of 2024 Felonies of Third Nasr City, to the Criminal Court for charges of kidnapping, sexual assault, and premeditated murder, all punishable by death.

The Public Prosecution stated that it had received a report about the discovery of the victim’s body, a 10-month-old Sudanese infant, in a public garden near her home. Prosecutors moved to the scene to examine and document the crime.

Investigations revealed that the defendant abducted the child while she was playing outside her home with her sister and took her to a nearby garden, where he assaulted her. When she screamed, he strangled her to death.

The defendant later confessed during investigations, and his confession was supported by forensic medical reports.
